The destination of the goods is determined by an official of the customs authority based on the nature, quantity and frequency of movement.
An official of the customs authority, when making a decision on the destination of goods, is based on the following criteria:
The nature of the goods — this takes into account the consumer properties of goods intended to meet family and household needs that are not related to commercial use.;
Quantity of goods — homogeneous goods (of the same name, size, style, color, and others) in an amount clearly exceeding the need of the person moving the goods and his family members are considered as goods imported for use in commercial activities;
The frequency of movement of goods is the repeated movement by the same person of similar goods, even in small quantities, is considered as goods being moved for commercial use, unless the person moving the goods proves otherwise.
